A US federal judge has temporarily postponed the deadline for federal employees to decide on the Trump administration's deferred resignation offer. Originally set for February 6, the new deadline is now Monday. This change follows a lawsuit filed by several federal unions, including the American Federation of Government Employees (AFGE) and the American Federation of State, County and Municipal Employees (AFSCME).
The administration informed federal workers of the court-ordered delay via email, but did not mention the possibility of further delays during a hearing scheduled for Monday afternoon. Before the judge's order, eligible federal employees had until 11:59 pm ET on Thursday to decide whether to accept the offer, which allows them to leave their positions but still receive pay through the end of September.
The lawsuit, filed in US District Court in Massachusetts, seeks a temporary restraining order to halt the "Fork Directive" deadline. The unions argue that the directive is an unlawful ultimatum that could lead to job loss without compensation. They demand a lawful policy instead.
US District Judge George O'Toole, appointed by President Bill Clinton, ruled to halt the plan's implementation while reviewing more information. Federal unions have advised members against accepting the package, questioning its legality and the Trump administration's ability to fulfill its promises. At least 65,000 federal workers have opted into the deferred resignation program.
