The group argued that the removal of certain web pages by the Department of Health and Human Services violated federal law, as these pages were used for patient treatment and research. Judge Bates found that the challengers were likely to succeed in their claim that the removal of medical information by the Department of Health and Human Services, CDC, and FDA was unlawful.
President Trump's executive order, signed on his first day in office, recognized only two sexes and directed federal agencies to remove materials promoting gender ideology. Following this, the Office of Personnel Management instructed agencies to take down related websites and social media accounts by January 31. This led to the removal of various web pages, including those with medical guidance on sexually transmitted infections and adult immunization.
