Delhi High Court Quashes FIR Against Mahamed Sharif After Settlement with Hotel Leela Palace

The Delhi High Court recently quashed an FIR lodged against Mahamed Sharif for non-payment of outstanding bills to Hotel Leela Palace. The court’s decision came after the hotel confirmed that Sharif had settled all outstanding dues.

Details of the Case

An FIR was initially filed at Police Station Sarojini Nagar in 2023 following a complaint by a hotel official. Justice Anish Dayal quashed the FIR after considering the facts and submissions, noting that continuing the case would be a misuse of court resources and an unnecessary burden on the state exchequer.

Statements from the Court

Justice Anish Dayal stated, “Considering the above settlement between the parties and the chances of conviction of the petitioners being remote and bleak, there is no use continuing with proceedings of the present FIR as it would be a misuse of the process of the Court and an unnecessary burden on the State exchequer.”

The authorised representative of Hotel Leela Palace, who was present in court, confirmed that they had no objection to quashing the FIR in view of the payment by the accused of their outstanding dues.

Legal Proceedings

Mahamed Sharif had moved a petition through Advocate Samar Khan seeking to quash the FIR based on the settlement recorded by the parties before the trial court on February 2, 2023. The court granted bail to Sharif after the hotel confirmed that all outstanding dues had been settled.
