Delhi High Court Dismisses Kalawati’s Petition on Santosh Koli’s Death

The Delhi High Court has dismissed a petition by Kalawati, mother of former AAP worker Santosh Koli, challenging a trial court’s decision not to register an FIR regarding her daughter’s 2013 death. Kalawati alleged a political conspiracy involving former Chief Minister Arvind Kejriwal and other AAP members. Justice Neena Bansal Krishna upheld the trial court’s ruling, stating the claims did not justify an FIR under the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act, 1989.

The court found that Kalawati’s allegations suggested a conspiracy but lacked specific caste-based abuse necessary for the Act’s invocation. The trial court had previously determined no offense under the Act was established, leading to the rejection of the FIR application. Kalawati, 60, claimed her daughter was murdered as part of a political conspiracy and criticized the lack of police action despite her complaints.

Kalawati highlighted her daughter’s bravery, noting Santosh Koli’s recognition with a Bravery Award by former President Abdul Kalam. She alleged that Koli was forced to contest the Delhi Assembly Elections with assistance from individuals assigned by Kejriwal. The family has accused the AAP of failing to investigate Koli’s death, which they believe was a murder disguised as a road accident.
