West Bengal Congress Leader Seeks Action Against TMC’s Humayun Kabir and Yusuf Pathan

In Kolkata, West Bengal, Congress leader Soumya Aich Roy has reached out to Governor CV Ananda Bose, urging action against Bharatpur MLA Humayun Kabir and Berhampur MP Yusuf Pathan. Roy accuses them of allegedly using religious polarization to win the 2024 general elections.

In a letter dated October 3, Roy highlighted a statement by Humayun Kabir, the elected MLA of Bharatpur, Murshidabad. Kabir allegedly admitted to polarizing voters based on religion to secure victory for Yusuf Pathan in the Berhampur Lok Sabha constituency. This statement has reportedly caused unrest.

Roy argues that Kabir’s actions violate laws and the constitution. Section 196 of The Bharatiya Nyay Sanhita 2023 states that promoting enmity between groups on religious or racial grounds is punishable. Additionally, Article 19 of the Indian Constitution restricts freedom of speech when it threatens India’s sovereignty and integrity. Roy questions why Kabir’s legislative membership should not be revoked and why the 2024 Berhampur election should not be declared void.

Trinamool Congress leader Yusuf Pathan won the Baharampur parliamentary seat in the 2024 elections, defeating Congress leader Adhir Ranjan Chowdhury with 524,516 votes.
