The Mainland Affairs Council (MAC) of Taiwan has strongly criticized a new guideline issued by Chinese authorities. This guideline threatens to punish ‘diehard’ advocates of Taiwan independence with the death penalty. The MAC described the move as harmful to exchanges between people on both sides of the Taiwan Strait and stated that Beijing has no jurisdiction over Taiwan.

In a press release, the MAC called the guideline ‘regrettable’ and ‘provocative.’ They also advised Taiwanese residents in China or those planning to travel there to be cautious.

Details of the New Guideline

Chinese officials announced the new guidelines at a press conference in Beijing. These guidelines, based on existing Chinese laws like the 2005 Anti-Secession Law, outline severe penalties for those found guilty of inciting secession. In serious cases, this could include the death penalty.

The guidelines were issued by several Chinese authorities, including the Supreme People’s Court and the ministries of public security, state security, and justice. They will take effect immediately.

Specifics of the Guideline

The document details offenses such as organizing, planning, or executing schemes for ‘de jure independence’ and seeking independence through foreign support or force. It also states that those who collude with foreign entities in committing such crimes will face harsher punishments.

Under Article 6, those guilty of splitting the state may face the death penalty if their actions cause significant harm to the state and its people or if the circumstances are particularly severe. However, the guidelines also mention that if separatists voluntarily renounce their stance and take steps to mitigate harm, they may have their cases dismissed or be exempted from prosecution.
