Supreme Court’s Decision on Aligarh Muslim University’s Minority Status
The Supreme Court of India has overruled the 1967 decision in the S Azeez Basha versus Union of India case, which stated that Aligarh Muslim University (AMU) could not be considered a minority institution due to its status as a Central university. Vice Chancellor Naima Khatoon announced plans to consult legal experts on the next steps. The court’s 4:3 majority verdict has referred the issue of AMU’s minority status to a regular three-judge bench, emphasizing the importance of identifying the institution’s founders to determine its minority status.
AMU staff, including Professor Mohd. Aasim Siddiqui and Omar Saleem Peerzada, expressed support for the decision, highlighting their commitment to academic excellence and inclusivity. Professor Aftab Ahmad noted that the judgement did not alter AMU’s minority status, and further analysis of the ruling is needed.
The Chief Justice of India, along with Justices Sanjiv Khanna, JD Pardiwala, and Manoj Misra, formed the majority opinion, while Justices Surya Kant, Dipankar Datta, and Satish Chandra Sharma dissented. The verdict follows a 2006 Allahabad High Court ruling that AMU was not a minority institution, which was contested by the university and the Congress-led UPA government. Maulana Khalid Rasheed Firangi Mahali of the All India Muslim Personal Law Board welcomed the decision, emphasizing its significance in determining AMU’s minority status and the implications for Article 30A.
