Supreme Court Rejects Plea on Jauhar University Land
The Supreme Court of India has declined to consider the Maulana Mohammad Ali Jauhar Trust’s appeal against the Uttar Pradesh government’s decision to revoke its lease on the land of Jauhar University in Rampur. The decision was made by a bench led by Chief Justice DY Chandrachud, along with Justices JB Pardiwala and Manoj Misra. The court stated, “We will not entertain the petition,” and suggested that the UP government should find alternative educational institutions for the 300 affected students.
Senior Advocate Kapil Sibal, representing the Trust, expressed concerns about the students’ future, but the court remained firm. The Trust had contested an Allahabad High Court ruling that supported the government’s decision. The High Court had criticized the original lease agreement, citing ignored procedures and financial mismanagement, labeling it an abuse of power by a Cabinet Minister.
The Maulana Muhammad Ali Jauhar Trust, led by Samajwadi Party leader Azam Khan, was granted the land in 2005. However, in January 2023, the Yogi government canceled the lease, which was initially set at Rs 100 per annum, and reclaimed the 13,000 square meters of land. The lease was originally for 33 years with options for extension. Following a complaint, an SIT investigation led to the lease’s cancellation based on their findings and a report from the Rampur District Magistrate.
