The Supreme Court of India has turned down Karnataka Deputy Chief Minister DK Shivakumar’s request to dismiss the Central Bureau of Investigation’s (CBI) case against him. The case involves allegations of disproportionate assets under the Prevention of Corruption Act.

Background

The CBI’s investigation into DK Shivakumar began after an Income Tax raid in 2017. The Enforcement Directorate (ED) also conducted a probe, leading the CBI to seek permission from the state government to file an FIR. This permission was granted on September 25, 2019, and charges were filed on October 3, 2020.

Legal Proceedings

Shivakumar’s plea was initially rejected by the Karnataka High Court. The Supreme Court’s recent decision upholds this rejection. The case was brought to the High Court by BJP MLA Basangouda Patil Yatnal, who challenged the state government’s decision to drop the CBI probe.

Political Reactions

The Congress-ruled Karnataka government had approved a proposal to withdraw the CBI investigation in November, which led to significant political conflict between the BJP and Congress. The BJP criticized the decision as “totally illegal.”
