Supreme Court Questions Delhi Government on Firecracker Ban Violation During Diwali
The Supreme Court of India has raised concerns with the Delhi government regarding the violation of the firecracker ban during Diwali celebrations. A bench comprising Justices Abhay S Oka and Augustine George Masih has requested the Delhi government to submit an affidavit detailing the measures taken to enforce the ban and address air pollution.
The court noted widespread reports indicating the ban was not effectively implemented and demanded an immediate explanation from the Delhi government. Additionally, the court has issued a notice to the Delhi Police Commissioner regarding non-compliance with the ban.
The bench highlighted the need for immediate action under the Air Prevention Act, 1981, which now includes penalty provisions. The Delhi government and the Police Commissioner have been directed to file affidavits within a week, outlining future steps to prevent similar occurrences. The court also suggested considering a permanent ban on firecrackers in Delhi.
Furthermore, the court has requested affidavits from the governments of Haryana and Punjab regarding stubble burning incidents in late October. The hearing was part of a plea addressing air pollution in and around Delhi. Additional Solicitor General Archana Pathak Dave informed the court of significant non-compliance with firecracker restrictions during Diwali, noting a rise in air pollution from 10% to 27% on the festival day.
