Supreme Court Questions Delhi LG on MCD Election

The Supreme Court of India has asked the office of Delhi Lieutenant Governor VK Saxena to respond to a plea by Shelly Oberoi, Mayor and Aam Aadmi Party leader, regarding the election of the 6th member of the Municipal Corporation of Delhi (MCD) Standing Committee. Justices PS Narasimha and R Mahadevan expressed concerns over the LG’s decision to hold the election without the Mayor’s presence, questioning the use of executive powers under Section 487 of the Delhi Municipal Act.

Senior advocate Sanjay Jain, representing the LG, argued that the Mayor postponed the election, violating a court directive. Meanwhile, advocate Abhishek Manu Singhvi, representing the Mayor, requested the court to halt the election process. The court instructed the LG’s office not to proceed with the election until the matter is heard.

Mayor Shelly Oberoi’s petition challenges the election held on September 27, won by the BJP, claiming it was unconstitutional. She argues that the election should be conducted by the Mayor, not an IAS officer, as per the Delhi Municipal Corporation Act.
