Supreme Court Questions Delay in Prisoner Remission Files Signed by Jailed Delhi CM Arvind Kejriwal

The Supreme Court of India on Friday asked if there are any restrictions on jailed Delhi Chief Minister Arvind Kejriwal from signing files for the remission of prisoners. This question arose when the court learned that a convict’s early release file was delayed due to Kejriwal’s signature.

A bench of Justice Abhay S Oka and Justice Augustine George Masih sought to know if there is any restraint order against Kejriwal for not signing remission files from jail. The court noted that Kejriwal is in jail due to alleged liquor policy irregularities.

Additional Solicitor General Aishwarya Bhati and Senior Advocate Archana Dave, representing the respondents, said they would take instructions on this matter. The court emphasized the need to resolve such issues promptly and mentioned it could use its power under Article 142 of the Constitution of India if necessary.

The court adjourned the matter and stated it would examine if there is any restraint order on the Chief Minister performing his duties from jail, as this could affect hundreds of cases. The court was hearing a plea by a convict seeking remission. On May 10, the Delhi Government counsel informed the court that the concerned Board was considering the petitioner’s case for permanent remission. On July 19, the court granted the Delhi Government more time to decide, extending the deadline by one month. However, upon learning of further delays, the court expressed its inability to keep the matter pending for long.
