Supreme Court Petition Against Demolition Notices in Bahraich Violence Case
In New Delhi, a petition has been filed in the Supreme Court of India challenging demolition notices issued by Uttar Pradesh authorities. These notices target several individuals, including Abdul Hameed, who is accused in the Bahraich violence case, for alleged illegal construction.
The Public Works Department (PWD) issued a demolition notice for Hameed’s residence in Bahraich. Three petitioners, represented by advocate Mrigank Prabhakar, have requested the Supreme Court to nullify the demolition notices dated October 17, 2024, which were posted on October 18, 2024.
The petitioners are also seeking interim relief to halt the proposed demolitions and maintain the current status as of the notice’s issuance date. They argue that the demolitions are punitive, claiming that the “unauthorized construction” defense is being used as a pretext for punitive actions and to bypass interim protective orders issued by the Court on September 17, 2024.
The petitioners further assert that the demolition actions are motivated by “malice” due to the rapid initiation of the process by the authorities. They believe the demolition notices are linked to the recent communal unrest and violent incidents, based on the alleged involvement of the property owners or residents in these activities.
