Supreme Court Pauses Defamation Case Against Delhi Leaders Kejriwal and Atishi
The Supreme Court of India has temporarily halted the criminal defamation case against current and former Delhi Chief Ministers Arvind Kejriwal and Atishi. The case was initiated by Bharatiya Janata Party (BJP) leader Rajeev Babbar over remarks made by Kejriwal and Atishi about the alleged deletion of voter names from the electoral roll in 2018.
A bench of Justices Hrishikesh Roy and SVN Bhatti issued a notice to Delhi Police and Rajeev Babbar, seeking their responses. Meanwhile, the proceedings before the trial court will remain stayed.
Kejriwal and Atishi approached the Supreme Court after the Delhi High Court refused to quash the defamation case. The High Court had found the remarks to be prima facie defamatory, aimed at vilifying the BJP and gaining political mileage. The defamation complaint also names AAP leaders Sushil Kumar Gupta and Manoj Kumar.
The High Court had directed the AAP leaders to attend the trial court hearing scheduled for October 3. Kejriwal and the other AAP leaders challenged the trial court’s decision, which upheld the summons issued by the magistrate court following Babbar’s complaint. They argued that the complaint was politically motivated and that Babbar was not an aggrieved party.
