The Supreme Court of India has ruled that the West Bengal Government cannot stop women doctors from working night shifts or beyond 12 hours. This decision was made by a bench led by Chief Justice DY Chandrachud, along with justices JB Pardiwala and Manoj Misra.

The court was hearing a case related to the rape and murder of a doctor at RG Kar Medical College and Hospital in Kolkata. The West Bengal Government had issued a notification barring women from night duties and shifts longer than 12 hours. Senior Advocate Kapil Sibal, representing the West Bengal Government, stated that this measure was temporary and part of recent security measures, and assured that it would be removed.

The Supreme Court emphasized that women do not seek concessions but equal opportunities and are willing to work under all conditions. The court also highlighted the state’s responsibility to ensure the safety of women doctors.

Chief Minister Mamata Banerjee assured that no punitive or adverse action would be taken against doctors returning to work. The court expressed dissatisfaction with a lawyer’s application seeking the resignation of the Chief Minister, stating that the court is not a political forum.

Additionally, Solicitor General Tushar Mehta informed the court that the victim’s name and photograph were present on Wikipedia. The court directed Wikipedia to remove the victim’s identity to maintain the dignity of the victim.
