Supreme Court of India Rules All Married Women, Including Muslims, Can Claim Maintenance
The Supreme Court of India has made a significant ruling that Section 125 of the Code of Criminal Procedure (CrPC) applies to all married women, including Muslim women. This means they can claim maintenance from their husbands under these provisions.

The court emphasized that the 1986 Act, which also provides maintenance rights to divorced Muslim women, does not override Section 125 CrPC but adds to it. Therefore, Muslim women can choose to seek maintenance under either or both laws.

The ruling came in response to an appeal challenging a High Court of Telangana order that modified a family court decision on maintenance payments. The High Court had reduced the interim maintenance payable from Rs 20,000 to Rs 10,000 per month.
Senior Advocate S Wasim A Qadri, representing the husband, argued that Section 125 CrPC was not applicable due to the provisions of the 1986 Act. However, the Supreme Court upheld the High Court’s decision, stating that the petition under Section 125 CrPC was maintainable.
