Supreme Court Grants Bail to Arvind Kejriwal’s Aide Bibhav Kumar in Assault Case
The Supreme Court of India has granted bail to Bibhav Kumar, an aide to Chief Minister Arvind Kejriwal, who was accused of assaulting AAP Rajya Sabha member Swati Maliwal. A bench of Justices Surya Kant and Ujjal Bhuyan noted that Kumar had been in custody for 100 days and that the chargesheet had already been filed.
The court also considered that there are more than 51 witnesses proposed by the prosecution, and the trial’s conclusion will take some time. The court told ASG SV Raju, representing Delhi police, that Kumar should be granted bail as the injuries were simple and he had already been in custody for a significant period.
The court imposed several conditions on Kumar, including that he shall not be restored to his position as PS of the Delhi Chief Minister or any political office associated with the CM’s office. Additionally, Kumar is not allowed to enter the Chief Minister’s residence until all witnesses are examined and must refrain from making any public comments on the case.
During the hearing, senior advocate Abhishek Manu Singhvi, representing Kumar, argued that the injuries to Maliwal were simple and that the charges under Section 308 of the Indian Penal Code were not justified. ASG Raju argued that the bail should be deferred until the examination of private witnesses is complete.
Kumar had approached the Supreme Court after the Delhi High Court denied him bail, citing his considerable influence and the potential for witness tampering. An FIR was registered against Kumar on May 16 under various provisions of the Indian Penal Code, including criminal intimidation and assault.
