Supreme Court Fines National Medical Commission Rs 10 Lakh for Unfair Actions

The Supreme Court of India recently criticized the National Medical Commission (NMC) for not acting fairly in a case involving a medical college. The college had received approval to increase its seats from 150 to 250 for the academic year 2023-24, but this approval was later withdrawn. The NMC challenged a Kerala High Court order that supported the college, but the Supreme Court upheld the High Court’s decision.

A bench of justices BR Gavai and KV Viswanathan noted that the NMC, as a state organ, should act in a fair and reasonable manner. The court imposed a Rs 10 lakh fine on the NMC, stating that making the college run from court to court was an attempt to harass the institution, which has been operating for 18 years.

The Supreme Court ordered that the fine be paid within four weeks. Rs 5 lakh of the fine will go to the Supreme Court Advocates-on-Record Association for library purposes, and the remaining Rs 5 lakh will go to the Supreme Court Bar Association Advocates Welfare Fund.
