Sukesh Chandrasekhar Granted Bail in AIADMK Bribery Case but Remains in Jail
New Delhi, India – On Friday, the Rouse Avenue Court of Delhi granted bail to Sukesh Chandrasekhar in a bribery case involving the AIADMK’s ‘two-leaves’ symbol. Despite this, Chandrasekhar will remain in jail due to other ongoing cases against him.
Special Judge Vishal Gogne emphasized the importance of liberty and the need to avoid long detentions without final proceedings. He stated that the accused is entitled to bail under section 479 (1) and the third Proviso to section 479 of the BNSS.
The court noted that delays in the proceedings were not Chandrasekhar’s fault, as he was exercising his right to challenge the charges. The Supreme Court and High Court of Delhi had stayed the proceedings, and this could not be used to penalize him.
Advocate Anant Malik, representing Chandrasekhar, argued that his client had been detained for over 7 years and 4 months since his arrest on April 15, 2017. The charges against him, including sections of the Prevention of Corruption Act and the Indian Penal Code (IPC), do not carry punishments exceeding 7 years.
However, the Delhi Police opposed the bail, citing the serious allegations of recovering Rs. 1.3 crores in cash from Chandrasekhar, which was allegedly intended to influence the Election Commission for a favorable election symbol for an AIADMK faction.
The supplementary chargesheet filed by the Delhi Police included names such as AIADMK leader TTV Dhinakaran, along with Chandrasekhar and others like Mallikarjuna, Nathu Singh, Pulkit Kundra, B Kumar, Lalit Kumar, Jai Vikram Haran, and Narendra Jain.
The case involves allegations that TTV Dhinakaran attempted to bribe the Election Commission to secure the party’s ‘two leaves’ symbol. Chandrasekhar was arrested from a Delhi hotel with Rs. 1.30 crore in cash, and the police also seized a BMW and a Mercedes car from him.
