Sukanta Majumdar Criticizes TMC’s New Committee on Criminal Laws
Kolkata [India], July 19: Union Minister and West Bengal BJP President Sukanta Majumdar has criticized the All India Trinamool Congress (TMC) government for forming a special seven-member committee to scrutinize three new criminal laws. Majumdar accused the TMC government of violating and insulting the Constitution, stating that no committee can probe a law passed by both Lok Sabha and Rajya Sabha.
Majumdar said, “A law that has been introduced by the central government and has been passed in Lok Sabha and Rajya Sabha, no such committee can probe a law like that. There is no such provision in the Constitution. They (the TMC government) are violating and insulting the Constitution.”
On July 17, the West Bengal government formed a special seven-member committee to scrutinize three new criminal laws, including the Bhartiya Nayay Sanhita, before implementing them in the state. The committee includes Asim Kumar Roy, Malay Ghatak, Chandrima Bhattacharya, LD Advocate General Kishore Dutta, Sanjay Basu, West Bengal Police DG Rajiv Kumar, and Kolkata Police Commissioner Vineet Goyal.
The committee has the power to engage academic experts, senior advocates, research assistants, and other legal experts to seek their views. The state government stated that the committee would suggest state-specific amendments, consider changing the names of the criminal laws at the state level, and address any other necessary matters.
The new criminal laws, effective from July 1, 2024, require FIRs to be recorded within three days of complaints submitted electronically. Courts must frame charges within sixty days from the first hearing and pronounce judgments within 45 days after a trial concludes. Judgments must be uploaded within seven days of pronouncement, ensuring swift justice delivery.
