New Delhi [India], June 24: Saquib Abdul Hamid Nachan has approached the Delhi High Court, challenging a trial court’s decision to deny him bail. The trial court had extended the investigation period on May 20, 2024, which Nachan claims is illegal.

Background

Nachan was previously convicted for his involvement in the 2002 and 2004 Mumbai blasts. He has now moved the high court through his lawyer, Mubin Akbar, contesting the trial court’s orders from April 19 and May 20, 2024.

Legal Arguments

Nachan argues that the extension of the investigation period and his judicial custody were granted without following proper legal procedures. He claims that the National Investigation Agency (NIA) did not comply with the required provisions under Section 167 of the Criminal Procedure Code (CRPC).

Upcoming Hearing

The case has been listed for hearing on July 11 by a vacation division bench comprising justices Mini Pushkarna and Dharmesh Sharma.

Related Cases

In July 2023, an FIR was registered involving Shahnawaz Alam, who is absconding, and other accused persons. Subsequent FIRs were registered in September and November 2023, leading to the arrest of Nachan and others on December 9, 2023. Their judicial custody has been extended multiple times since then.
