Ladakh Activist Sonam Wangchuk Seeks Court’s Permission for Peaceful Protest in Delhi
On October 8, 2024, the Apex Body Leh approached the Delhi High Court to request permission for climate activist Sonam Wangchuk and other participants to hold a peaceful protest at Jantar Mantar or another suitable location in Delhi. The protest, planned from October 8 to October 23, 2024, aims to raise awareness about the ecological and cultural degradation in Ladakh and the Himalayan region.
The plea highlights the fundamental rights under Articles 19(1)(a) and 19(1)(b) of the Indian Constitution, which protect free speech and peaceful assembly. Approximately 200 participants began a peaceful march, called a Padyatra, from Leh, Ladakh, to New Delhi, covering over 900 kilometers in 30 days.
However, on October 5, 2024, the Delhi Police rejected the request for a peaceful demonstration at Jantar Mantar, citing “no valid grounds.” The petitioners argue that this rejection infringes on their fundamental rights and that the police have not provided reasonable grounds for their decision.
The matter was brought before a bench led by Chief Justice Manmohan and Justice Tushar Rao Gedela, who agreed to list the case for urgent hearing. The petitioners assure that the protest is a peaceful expression of dissent to communicate grievances to the authorities.
