New Delhi, India – Jagtar Singh Hawara, who was convicted for the assassination of former Punjab Chief Minister Beant Singh, has asked the top court to move him from Delhi’s Tihar Jail to a prison in Punjab. A bench of Justices BR Gavai and KV Viswanathan has requested responses from the Centre, Delhi Government, and Punjab Government regarding this plea.

Hawara’s plea, filed by advocate Satya Mitra, also asks for the court to review his prison conduct records. He is currently serving a life sentence in Tihar Jail for the murder of Beant Singh, a case registered in Punjab. The petition highlights that there are no pending cases against him in Delhi and that he should be confined in a Punjab prison as he is a native of Fatehgarh Sahib District in Punjab.

Hawara was arrested on September 21, 1995, and has been in jail for over 28 years. Initially sentenced to death in 2007, his sentence was changed to life imprisonment by the Punjab and Haryana High Court in 2010. Both the prosecution and Hawara have filed appeals in the Supreme Court, which are still pending.

The petition notes that Hawara’s conduct in jail has been clear except for a jailbreak on January 22, 2004, after which he was re-arrested in 2005. Since then, his behavior in prison has been without any issues. He is now 54 years old and has been in Tihar Jail since his re-arrest.

The petition raises the question of whether a person convicted of a serious crime but with a good prison record for the last 19 years can be transferred to a jail in Punjab. It also points out that there are no pending cases against him in Delhi.
