A man in New Delhi has asked the Delhi High Court to have the Delhi Police conduct a medical examination of his wife at a Central Government hospital to confirm her gender. He claims that his wife is a transgender individual, a fact he says was hidden from him before their marriage. This alleged concealment has caused him mental distress, prevented their marriage from being consummated, and led to false legal actions against him.

The husband’s plea, filed by Advocate Abhishek Kumar Choudhary, acknowledges that gender identity is a private matter. However, it argues that in marriage, both parties’ rights are interconnected. The plea stresses the importance of balancing and respecting the fundamental rights to life of both individuals, as guaranteed under Article 21 of the Indian Constitution, to ensure a healthy marital life.

The plea also states that the husband has a right to a fair investigation and determination of facts before facing legal proceedings meant for women. It argues that he should not have to pay maintenance or face allegations under domestic violence and dowry laws if his wife does not qualify as a “woman” under these laws.

Previously, the husband approached the trial court under Section 151 of the CPC to request a medical board for his wife’s examination, but the trial court dismissed his application.
