In Islamabad, the Lahore High Court Bar has taken a significant step by challenging the 26th Constitutional Amendment in Pakistan’s Supreme Court. This action was led by Hamid Khan, the Senior Vice-President of Pakistan Tehreek-e-Insaf. He filed a petition seeking to declare several sections of the amendment as unconstitutional.

Hamid Khan has specifically targeted sections 7, 9, 10, 12, 13, 14, 16, 17, and 21, urging the court to deem them unconstitutional. He also requested that any actions taken under these sections be restrained while the petition is pending. The petition names the federation, judicial commission, National Assembly, Senate, Speaker National Assembly, and the President as respondents.

Hamid Khan emphasized that restoring the constitution to its original form is a major issue in the Supreme Court Bar elections. He described the 26th Amendment as a significant threat to the constitution, unsettling the judicial system. The Supreme Court Bar Association elections are currently underway, with over 4,000 voters participating.

The 26th Amendment includes provisions such as setting the Chief Justice of Pakistan’s term at three years and involving a 12-member parliamentary committee in the nomination process. This committee will propose a candidate to the Prime Minister, who will then forward it to the President for approval. Additionally, a Judicial Commission of Pakistan will oversee the appointment of Supreme Court judges.
