Five Accused Sent to Jail in Rajinder Nagar Incident

A court in New Delhi has sent five people to jail in connection with an incident in Rajinder Nagar where three UPSC aspirants died. The accused include four landowners and a driver. The court will hear the bail application of the driver, Manuj Kathuria, tomorrow.

Details of the Incident

The accused were produced in court after a fresh arrest. Judicial Magistrate First Class Vinod Kumar remanded landowners Tejinder, Sarabjit, Harvinder, Parvinder, and driver Manuj Kathuria to judicial custody until August 12. The court is to hear the bail application of Manuj Kathuria tomorrow at 2 PM.

Arguments in Court

Advocate Rakesh Malhotra, representing Manuj Kathuria, argued that the arrest should be declared illegal due to violations of the Bharatiya Nagarik Suraksha Sanhita (BNSS). He claimed that the incident occurred in a library running in the basement and that no officers have been arrested, only private individuals.

Advocate Amit Chaddha, representing the four landowners, argued that they have no liability as the building was leased out. He also mentioned that Section 105 (Culpable homicide not amounting to murder) of the BNSS was added to bypass a Supreme Court judgment.

Investigating Officer’s Statement

The investigating officer stated that the four accused are owners of the basement and third floor, which were meant for parking and storage. He mentioned that the iron gate was crushed by the flow of water. A video was played in court, and the defense argued that its speed had been altered.

Next Steps

The court has asked the investigating officer if any notice had been issued to public servants. The officer confirmed that a notice had been issued to the Municipal Corporation of Delhi (MCD).
