First Case Under New Bharatiya Nyaya Sanhita Registered in Delhi

The first FIR under the new Bharatiya Nyaya Sanhita, 2023, was registered at Kamla Market Police Station in Delhi. This new law replaces the Indian Penal Code (IPC) with updated sections and new provisions.

Details of the Case

A street vendor named Pankaj Kumar, from Barh, Bihar, was charged under Section 285 of the Bharatiya Nyaya Sanhita. He was accused of obstructing a foot over bridge near New Delhi Railway Station by selling tobacco and water on a cart, causing trouble to commuters. When asked by police to move, he ignored the officials.

Changes in the Law

The Bharatiya Nyaya Sanhita has 358 sections, replacing the 511 sections of the IPC. It introduces 20 new crimes, increases imprisonment sentences for 33 crimes, and raises fines for 83 crimes. Mandatory minimum punishments have been added for 23 crimes, and community service penalties have been introduced for six crimes. Additionally, 19 sections have been removed.

The Bharatiya Nagrik Suraksha Sanhita replaces the CrPC with 531 sections, adding 177 changes, nine new sections, and 39 new sub-sections. It also includes 44 new provisions and clarifications, timelines for 35 sections, and audio-video provisions at 35 places. Fourteen sections have been removed.

The Bharatiya Sakshya Adhiniyam replaces the Indian Evidence Act with 170 provisions, adding two new provisions and six sub-provisions, while removing six provisions.
