DJI Challenges US Defense Department in Court
DJI, the leading drone manufacturer globally, has filed a lawsuit against the US Defense Department. The company is contesting its inclusion on a list of firms allegedly linked to China’s military. DJI, which dominates over half of the US commercial drone market, claims this designation is incorrect and has led to major financial setbacks.
The lawsuit, submitted in a Washington district court, seeks to remove DJI from the Pentagon’s list of “Chinese military companies.” DJI insists it is not owned or controlled by the Chinese military. This list warns US businesses about potential national security risks when dealing with these companies.
DJI argues that the Defense Department’s decision has caused it to lose business deals, face stigmatization as a security threat, and be banned from federal contracts. The company also reports that both US and international clients have canceled contracts and are hesitant to form new agreements.
The Defense Department has not yet responded to the lawsuit. DJI decided to take legal action after the Pentagon did not engage with them regarding the military designation for over 16 months. DJI stated, “We had no alternative other than to seek relief in federal court.”
This move is part of a larger US government effort to limit Chinese companies considered national security threats. The Pentagon’s list includes other major Chinese firms like AVIC, YMTC, China Mobile, and CNOOC. DJI is not alone in challenging this designation; Hesai Group, a LIDAR manufacturer, filed a similar lawsuit in May.
DJI is also under increased scrutiny in the US. Recently, US Customs and Border Protection blocked some DJI drones under the Uyghur Forced Labour Prevention Act, though DJI denies any forced labor involvement. US lawmakers have expressed concerns about DJI’s drones, citing data transmission and surveillance risks, which DJI disputes. The US House of Representatives has voted to ban DJI drones, with the decision pending Senate approval. The US Commerce Department is also considering restrictions that could ban Chinese drones in the US.
