Delhi Lawyers Protest New Criminal Laws Enacted by Central Government

On July 15, lawyers from all district Bar Associations in Delhi abstained from judicial work to protest against new criminal laws enacted by the Central Government. The protest was organized by the Coordination Committee of All Delhi Bar Associations.

Key Concerns

The lawyers are concerned about several provisions in the new laws, which have been in force since July 1, 2024. They argue that recording evidence of complainants or witnesses at police stations is unfair to the accused. Committee Chairman Jagdeep Vats stated, “There are many provisions, including that of evidence, period of custody, etc. which require amendments. We want the welfare of the public.”

Advocate Devender Dedha, additional secretary of the Committee, added, “It will prejudice the rights of the accused and these provisions are against public at large. Prosecution is not the business of prosecution agency.”

Impact on Courts

During the protest, court work was affected, and many litigants could only get new dates for their cases.

New Criminal Laws

The new criminal laws, effective from July 1, 2024, include:

  • FIRs to be recorded within three days of electronic complaints.
  • Charges to be framed within sixty days from the first hearing.
  • Trial in absentia for proclaimed offenders after ninety days from charge framing.
  • Judgements to be pronounced within 45 days after trial conclusion.
  • Judgements to be uploaded within seven days of pronouncement.

These changes aim to expedite criminal proceedings and ensure timely justice.
