Delhi High Court Urges Ministry of Home Affairs to Address Rohingya Children’s School Admissions
In New Delhi, a representation has been submitted to the Ministry of Home Affairs (MHA) following the Delhi High Court’s directions regarding the school admissions of Rohingya refugee children from Myanmar. This action follows a Public Interest Litigation (PIL) filed by the NGO Social Jurist, which sought to address the educational needs of these children.
The court noted that Rohingyas are considered foreigners without official recognition for entry into India. Consequently, the PIL was disposed of, instructing the NGO to approach the MHA for a legal resolution. The representation highlights that many Rohingya children in Sri Ram Colony, Khajoori Chowk, possess UNHRC-issued refugee cards and are of school age.
The NGO argues, citing Articles 14, 21, and 21-A of the Indian Constitution and the Right of Children to Free and Compulsory Education (RTE) Act, 2009, that all children in India are entitled to free education, regardless of citizenship. They emphasize the importance of a directive from the Ministry to benefit refugee children nationwide, asserting that no child should be denied education due to refugee status.
The Delhi High Court, led by Chief Justice Manmohan and Justice Tushar Rao Gedela, stressed the need for government action on this issue, stating it should not be resolved through court proceedings. The PIL also highlighted the Municipal Corporation of Delhi’s unlawful denial of educational benefits to Rohingya children, framing it as a violation of their fundamental rights.
