Delhi High Court Stops Bail for Chief Minister Arvind Kejriwal

Delhi Minister Saurabh Bharadwaj expressed surprise that the Delhi High Court stayed the trial court’s order granting bail to Chief Minister Arvind Kejriwal without reading the trial court’s order. The High Court stated that the trial court did not properly consider the requirements of section 45 of the Prevention of Money Laundering Act.

The Enforcement Directorate (ED) had challenged the bail, and the High Court halted Kejriwal’s release until further notice. The bench of Justice Sudhir Kumar Jain noted that the trial court should have recorded its satisfaction with the fulfilment of the twin conditions of section 45 of PMLA before passing the order.

On June 20, the trial judge granted bail to Kejriwal in the money laundering case. The next day, the ED moved an urgent petition before the High Court challenging the bail order. The High Court heard both sides extensively and reserved orders on the ED’s application to stay the bail order.
