Delhi High Court Reviews Umar Khalid’s Bail Request in 2020 Riots Case
The Delhi High Court has issued a notice to the Delhi police regarding Umar Khalid’s bail application in a UAPA case related to the alleged larger conspiracy of the 2020 Delhi Riots. The division bench of Justices Suresh Kumar Kait and Girish Kathpaliya has scheduled the next hearing for August 29.
Umar Khalid, a former JNU student leader, has been in custody since September 2020. He is one of the accused in the larger conspiracy case of the 2020 Delhi Riots. Despite filing charge sheets and supplementary charge sheets, the investigation is still ongoing.
On May 28, Delhi’s Karkardooma Court refused to grant regular bail to Umar Khalid. The trial court referred to the Delhi High Court’s order, which stated that the allegations against him are prima facie true and that he does not deserve bail. Special Judge Sameer Bajpai noted that the High Court had conducted a surface analysis of the evidence and concluded that a prima facie case is made out against Khalid.
The trial court also mentioned that the High Court had already dismissed Khalid’s criminal appeal on October 18, 2022. Khalid had approached the Supreme Court but later withdrew his petition. His bail applications have been dismissed twice by the trial court.
Umar Khalid sought regular bail under Section 437 of the Code of Criminal Procedure, 1973, read with Section 43D (5) of the Unlawful Activities Prevention Act, 1967.
