The Delhi High Court has ordered a DNA test to determine the paternity of a minor child after a man claimed to be the child’s biological father. The child’s mother, who is the man’s sister-in-law, denies his claim. The court has directed both the man and the child to provide DNA samples at Babu Jagjivan Ram Memorial Hospital. The results will be submitted by October 14. Meanwhile, the child will stay at a children’s home in Delhi, and the man can visit him daily for an hour.

Background

The man, who is married and lives in Calcutta, claims that the child has lived with him for the past 12 years. He filed a petition seeking the child’s custody, stating that the child was taken from him during a visit to Bihar. The child’s mother, however, claims that the child was only staying with the man for educational purposes.

Court’s Decision

Justices Prathiba M Singh and Amit Sharma directed the DNA test to resolve the dispute. The court interacted with the child, who stated that he has always lived with the man and his wife, whom he calls ‘Bade Papa’ and ‘Badi Mummy’. The court has scheduled the next hearing for October 14, by which time the DNA test results are expected to be submitted.

Current Arrangements

Until the next hearing, the child will stay at the Children Home for Boys (CHB) in Alipur, Delhi. The man is allowed to visit the child daily for one hour. The court’s decision aims to ensure the child’s well-being while the paternity issue is resolved.
