Delhi High Court Orders Complaint Against Manoj Gogia for Fake Medical Records

The Delhi High Court has recently directed the filing of a complaint against Manoj Gogia, also known as Maanav Maan, for submitting false medical records to obtain interim bail. Gogia is an accused in a rape and cheating case, with his appeal against the conviction and sentence pending before the court.

Gogia was granted interim bail in December 2023, which was extended on July 2, 2024, until August 8, 2024, on the grounds that he had surgery scheduled for July 7. He filed a new application for further extension, relying on documents from Aadhya 9 Multi-speciality Hospital. However, the hospital confirmed on August 7, 2024, that the records were fake and had not been issued by them.

A division bench comprising Justices Prathiba M Singh and Amit Sharma dismissed Gogia’s interim bail plea and directed the filing of a complaint against him for submitting a false affidavit and fabricated medical records under Section 379 of the Bharatiya Nagarika Suraksha Sanhita, 2023. The Registrar General has been instructed to file the complaint with the concerned Judicial Magistrate First Class (JMFC).

The High Court also dismissed all applications seeking an extension of the interim suspension of Gogia’s sentence. Additional Public Prosecutor Ritesh Bahri argued that Gogia should not be granted any extension and should surrender immediately due to the seriousness of the allegations and the fake documents.

Gogia’s counsel argued that previous records from Dr. Preet Singh Chawla were verified and that the reasons for the non-verification by Aadhya Hospital were unknown. However, the court found the hospital’s letter clear and categorical, stating that the records were fake and fabricated, and thus, Gogia could not be shown any compassion.
