Delhi High Court Issues Notice in CISF Officer’s Contempt Plea

The Delhi High Court has issued a notice to the Director General of the Central Industrial Security Force (CISF) and other authorities in response to a contempt plea filed by Assistant Commandant Diwakar Pande. Pande claims that a promotion list was issued despite a stay on promotions ordered by the court.

The vacation bench of Justice Dharmesh Sharma has directed the filing of a short affidavit and scheduled the matter for hearing on July 8. Advocate Ajay Sharma, representing Pande, argued that the promotion list from Assistant Commandant/JAO (Junior Administrative Officer) to Deputy Commandant/Executive was issued on May 30, 2024, despite the court’s stay orders on October 7, 2022, and February 3, 2023.

The court’s order from October 7, 2022, stated, “Till further orders, the appointment for LDCE (Limited Departmental Competitive Exam) recruited and direct recruitment of Assistant Commandant/Executive and promotion of Assistant Commandant/JAO to Deputy Commandant/Executive shall be stayed.” The February 3, 2023, order modified this, stating that any selection for the post of Assistant Commandant in the CISF would be subject to the outcome of the present petition.

In 2022, Pande and others had filed a petition seeking regular promotions from Inspector/Executive to Assistant Commandant/Executive, along with consequential benefits. Following the petition, Pande and others were promoted to Assistant Commandant. However, the current plea contends that the promotion from Assistant Commandant/JAO to Deputy Commandant/Executive violates the rules.
