Background

Samresh Jung, who has coached Olympic medalist Manu Bhaker, resides in the house along with his family. The Central Government issued a demolition notice on March 1, 2024, affecting around 1,000 residents in the 32-acre Khyber Pass Market area. The notice declared all residents as unauthorized occupiers and initiated a blanket eviction and demolition drive.

Legal Arguments

Samir Jung, represented by Advocates Rohit Yadav, Sahil Siddiqui, and Gultash Guron, contended that the notice was arbitrary and did not follow due procedure. The plea highlighted the family’s long-standing legal status as sub-tenants and their contributions to the nation. Their grandfather, Colonel Sher Lung, was a freedom fighter and war hero, and the family has been recognized for their service to the country.

Court’s Decision

Justice Sanjeev Narula dismissed the petition, stating that the petitioner had no legal right to the property. He acknowledged the difficulty of the situation but emphasized that making exceptions would be challenging. Some houses in the area have already been demolished, and the authorities have initiated the action.

Current Situation

Samresh Jung is currently in Paris, serving as the Head Coach of the Indian Air Pistol team, which has won two bronze medals in the 2024 Olympics. Despite their contributions, the Jung family faces the risk of eviction from their home in the Bhutta Singh Building.
