Delhi High Court Delays Final Order on Delhi Riots 2020 Case Involving Devangana Kalita
The Delhi High Court has instructed the Trial Court to delay its final order on framing charges in the Delhi riots 2020 case until September 23. The trial court has started hearing arguments on the charges.
Devangana Kalita’s Requests
Devangana Kalita, who is accused in the case, has requested the Delhi Police to provide videos and WhatsApp chats related to the protests at Jafrabad in February 2020. She has also sought an interim stay on the trial court proceedings, which the High Court has refused.
Arguments from Kalita’s Lawyer
Kalita’s lawyer, Advocate Adit S Pujari, argued that the videos were recorded by people hired by the Delhi Police and were listed in the charge sheet but not provided to the accused. He claimed that the videos would show that the protests were peaceful.
Special Public Prosecutor’s Objections
Special Public Prosecutor Madhukar Pandey, representing the Delhi Police, objected to the maintainability of Kalita’s petition, stating that the investigation is still ongoing and other evidence exists against the accused.
Justice Amit Bansal questioned the objection to providing the videos if they are part of the charge sheet. The Special Public Prosecutor responded that the investigation is still underway and other evidence is also being considered.
