Delhi Court Orders Police to Preserve CCTV Footage in Drowning Incident Involving Manuj Kathuria
New Delhi, August 2: Delhi’s Tis Hazari court has issued a notice to the Delhi Police to preserve and produce CCTV footage related to a drowning incident in Old Rajender Nagar. This order came after a plea was filed by Manuj Kathuria, the SUV driver involved in the incident.
Manuj Kathuria was granted bail by the session court, and Judicial Magistrate Vinod Kumar has sought a reply from the Investigation Officer (IO) of the case. The court will further hear the matter on August 7.
The plea, filed by Advocates RK Tripathi and Sahil Ahuja, requests the preservation of CCTV footage from one hour before and 30 minutes after the incident. The footage is essential to determine Kathuria’s role in the incident, where he allegedly drove his vehicle rashly, causing water to flood a basement and resulting in three deaths.
Additional Session Judge Rakesh Kumar noted that the offence under Section 105 of the Bharatiya Nyay Sanhita (BNS) 2023, which is non-bailable, is not applicable at this stage. The rest of the sections are bailable.
Earlier, Kathuria’s bail was dismissed based on CCTV footage showing him driving on a heavily waterlogged road, causing a large displacement of water that led to the basement flooding. The footage also showed a passerby warning him of the danger, which he ignored.
The Delhi Police have filed a status report on Kathuria’s bail plea, stating they are not pressing Section 105 (Culpable Homicide not amounting to murder) of the BNS. The police allege that Kathuria was driving at high speed, causing three iron gates to crash due to the wave created by his vehicle.
The court will review the matter again on August 7.
