New Criminal Laws in India

Introduction

On July 1, 2024, Bhopal Commissioner of Police Harinarayanachari Mishra announced the implementation of three new criminal laws in India. These laws are designed to be more effective in addressing current challenges.

New Laws Replacing Old Ones

The new laws are:

  • Bharatiya Nyaya Sanhita (BNS), 2023
  • Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023
  • Bharatiya Sakshya Sanhita (BSS), 2023

These replace the old Indian Penal Code (IPC), 1860, the Code of Criminal Procedure (CrPC), 1973, and the Indian Evidence Act, 1872.

Preparation and Implementation

CP Mishra stated that preparations for the new laws included updating CCTVs and software, as well as continuous training for police officers. Camps are being organized in schools and colleges to make people aware of the new laws.

Key Changes in the Laws

The BNS now has 358 sections, down from 511 in the IPC. The BNSS has 531 sections, up from 484 in the CrPC. The BSS has 170 provisions, slightly more than the original 167.

Effectiveness and Modernization

CP Mishra emphasized that the new laws are designed to tackle organized crime and strengthen national unity. They incorporate changes to address social, economic, and technological challenges, making them more effective in curbing crime.

Conclusion

The new laws were passed by the Indian Parliament on December 21, 2023, received Presidential assent on December 25, 2023, and were published in the official gazette the same day. The Ministry of Home Affairs notified that the laws would come into force on July 1, 2024.
