The Supreme Court of India has paused the National Green Tribunal’s (NGT) directive for punitive action against the Executive Officer of Dasna in a water pollution case in Ghaziabad. Justices Abhay S. Oka, Ahsanuddin Amanullah, and Augustine George Masih issued a notice and scheduled the next hearing for December 9. The court stayed the NGT’s order for the Uttar Pradesh Pollution Control Board (UPPCB) to take action against the local body, provided the appellant deposits a compensation amount by December 2, 2024.

The case involves pollution in a pond near Siddha Peeth Devi Temple in Dasna, which has been under scrutiny since January 2022. The NGT had previously imposed an interim environmental compensation of Rs. 23,72,000 on Nagar Panchayat, Dasna, for not adhering to environmental norms. The Executive Officer of the Nagar Panchayat challenged these orders, arguing that approvals were pending from the state government.

The Supreme Court acknowledged the appellant’s concerns, granting interim protection and highlighting the need for due process and consideration of mitigating factors. The case revolves around the establishment of a Sewage Treatment Plant (STP) by Nagar Panchayat, Dasna, which the Tribunal found non-functional. The appellant argued that the Tribunal overlooked efforts made towards establishing the STP and the challenges faced in securing necessary funding and approvals.

The Tribunal’s orders were criticized for being disproportionate and not considering the practical challenges faced by local bodies. The appellant contends that the approach should encourage compliance rather than impose punitive measures, as the current orders may hinder environmental protection efforts.
