Supreme Court Criticizes Madhya Pradesh High Court’s Admission Order
The Supreme Court of India has expressed concerns over the Madhya Pradesh High Court’s decision to allow colleges to participate in the admission process. This decision was similar to a previous order that the Supreme Court had stayed. Justices BR Gavai and KV Vishwanathan emphasized that the High Court’s actions did not adhere to judicial propriety.
The Supreme Court had earlier stayed an order from the Madhya Pradesh High Court that permitted a college to participate in the admission process for the BAMS degree course for the academic year 2023-2024. Despite this, the High Court issued a similar order for the 2024-2025 academic year.
Senior Counsel DS Naidu, representing the appellant, argued that the impugned order should be set aside. The Supreme Court agreed, quashing the High Court’s order and allowing the appeal. The case has been sent back to the High Court for fresh consideration.
The Supreme Court clarified that the High Court should decide the petition based on its own merits, without being influenced by the current order. The Madhya Pradesh High Court is scheduled to hear the matter on October 14, 2024.
